| Child custody and the court of law | | Posted Monday, January 30, 2006 9:26:29 PM by Rose Martins | Child custody laws differ from state to state and country to country. There are usually many issues when dealing with a child custody case and child custody battles can sometimes turn ugly. In child care battles, parents and their lawyers are not always thinking about what is actually best for the child, and rather focus just on winning. Child custody rights usually favour the mother, but there are instances where the father is in favour.
When these battles turn really ugly, child care detectives and investigators can be called upon to research the parents and their capabilities of caring for the child. Sometimes the lawyer is just looking to find some "dirt" that will work in his favour, but there are times where the court is looking really looking out for what is best for the children involved in the child custody case.
A child custody case can sometimes drag on for much longer than necessary, fueled by the battles of the parents, and their determination to win. It does happen where the child custody case is just a formality, where the parents have amicably decided as to what is best for their child or children.
These children usually cope better with the situation than children who are dragged into court to favour one parent of the other. This is not a healthy situation.

| | | Child-support equation relies on many factors | | Posted Monday, January 08, 2007 2:49:21 PM by Blog57 Team | | Q: My brother and sister-inlaw recently got divorced. They have two children and have a shared-parenting plan with an equal division of visitation. Still, my brother was ordered to pay the full statemandated child-support amount. I think his lawyer is wrong to advise him to take the deal. What do you think? A: We think that there are a number of other factors that we would need to know to say that anyone made a mistake. The amount of child support is not solely related to the amount of parenting time your brother is allowed to exercise. Certainly, there are cases where parents pay less child support because of the time that they spend with their children. The court must consider, however, the incomes and expenses of the parties, division of medical and other child-related expenses and a number of other factors in addition to division of parenting time.... | |

| | | How Does Child Custody In Canada Work? | | Posted Sunday, December 17, 2006 12:49:44 PM by Blog57 Team | | In the confusion of divorce, most parents never consider the issue of child custody beforehand. Often communication between the spouses has broken down and both parents presume their assumptions about child custody to be accepted by the other parent. Often this is not the case. As a result, many divorcing parents find themselves confused and surprised by the prospect of child custody issues in divorce. The greatest misconception is that the primary caretaker is the presumed de-facto custodial parent. So, most parents who take the lead role in providing for the child in marriage simply assume that the law will recognize this role by giving him or her primary custody after divorce. Historical care, however, does not automatically guarantee child custody. If you have filed for a divorce and your ex has gone ahead and obtained a legal order to take custody of your child – the child can be legally taken away from you despite any caretaking role you may have had in your child's life.... | |

| | | Property settlement, child custody factors in fatal shooting | | Posted Monday, November 06, 2006 12:54:45 PM by Blog57 Team | | Bond for a man accused of shooting his ex-wife as she fought with his current wife has been increased from $100,000 to $500,000 after investigators concluded the victim was on her knees when she was shot. He had posted bond on the lower amount but has now been rearrested. Bob Ingram is accused of shooting his ex-wife, Kim Ingram, 38, with a deer rifle at his home last Thursday. Investigators said the shooting happened after festering ill feelings in the couple's divorce case were reopened. | | | C.A.: Courts May Not Modify Foreign Child Custody Order | | Posted Wednesday, November 01, 2006 10:52:32 PM by Blog57 Team | | California courts may not modify child custody orders of a foreign court which has exclusive, continuing jurisdiction over a marriage dissolution, the Fourth District Court of Appeal ruled yesterday. Eric Paillier and Christine C. Pence were married in California in 1992. They have one son, Brian Paillier, who was born in France in 1990, was raised in France, and has dual French and American citizenship. In 1998 the couple initiated divorce proceedings in France, which resulted in a divorce decree awarding Pence physical custody of Brian and granted Paillier visitation. The French court enjoined Pence from taking Brian out of France for a period of time that would prejudice Pailliers visitation rights. A French appellate court upheld the injunction in 2001. Undeterred, Ponce and Brian moved to California in 2003.... | |

| | | Court won't hear triplet custody case | | Posted Sunday, October 29, 2006 6:53:06 PM by Blog57 Team | | The Pennsylvania Supreme Court has refused to hear an appeal filed by a surrogate mother who lost custody of triplets she delivered nearly three years ago to their biological father. A lower court had ruled in April that Danielle Bimber had no standing to challenge the custody rights of James Flynn, 65. Since then, the boys have lived with Flynn in Kirtland, Ohio. The decision Tuesday means Ms. Bimber must now appeal to a federal court if she wants the case to continue. It was not clear whether she plans to appeal. "I knew there was a 95 percent chance that I wasn't going to get them back," Ms. Bimber told The Journal of Corry, Pa. "Now I know it's 100." Still to be decided is a suit Mr. Flynn filed that seeks $350,000, which includes legal fees, child support and the $20,000 surrogate fee he paid Ms.... | |
